1. Acceptance of Terms
By using drrefills.com, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use this service. These terms constitute a legally binding agreement between you and Dr. Refills Medical Group.
2. Description of Service
Dr. Refills provides asynchronous store-and-forward telehealth services for chronic medication refills in the State of California, pursuant to California Business and Professions Code §2290.5. A board-certified California physician personally reviews every refill request.
This service is strictly limited to:
- Refills of established chronic medications you have been taking for at least 3 months
- Medications on our approved formulary
- Adults age 18 and older currently located in California
- Cash-pay only — we do not bill insurance
This service does not provide:
- Emergency medical care
- New prescriptions for conditions not previously treated
- Controlled substances of any kind
- Dose changes
- Insulin or GLP-1 medications
- Diagnosis of new conditions
- Primary care or ongoing care management
3. AI-Assisted Intake
Our intake process uses an AI system called Maya, powered by Anthropic Claude. Maya is an administrative intake assistant only. It does not provide medical advice, diagnoses, or prescriptions. All clinical decisions are made exclusively by a California-licensed board-certified physician after reviewing your intake information.
As required by California AB 3030, we disclose that generative AI technology is used in our intake workflow. A licensed physician reviews every case before any prescription decision is made.
4. No Doctor-Patient Relationship Until Approved
Submitting an intake request does not establish a doctor-patient relationship. A physician-patient relationship is established only when a physician reviews and approves your request and a prescription is transmitted. Each encounter is evaluated independently.
This service supplements but does not replace your relationship with a primary care physician. We strongly encourage you to maintain regular care with a PCP for ongoing management of your conditions.
5. Physician Notice to Patients
California law requires us to inform you that our physicians are licensed by and regulated by the Medical Board of California. You may verify physician license status and disciplinary history at breeze.ca.gov or by calling (800) 633-2322.
6. Fees and Payment
The physician service fee is $59 per approved request. This fee covers the physician’s clinical review and electronic prescription only. It does not include the cost of your medication, which is paid separately at your pharmacy.
You will only be charged if your request is clinically appropriate and approved by the reviewing physician. A payment link will be sent to your phone number by text message. Prescription is transmitted within one hour of payment confirmation.
Payments are processed securely by Stripe. We do not store credit card information.
Refunds: If a technical error prevents prescription transmission after payment, we will issue a full refund within 3 business days. We do not refund physician review fees for requests that were clinically evaluated but denied after payment was received in error. Contact admin@drrefills.com for refund requests.
7. Your Responsibilities
By using this service, you agree to:
- Provide accurate and complete health information
- Disclose all current medications, supplements, and health conditions
- Not use this service for conditions requiring emergency care
- Be 18 years of age or older
- Currently be located in the State of California
- Have been taking the requested medication at the same dose for at least 3 months
- Not attempt to obtain controlled substances through this service
- Maintain a relationship with a primary care physician for ongoing care
Providing false information may constitute fraud and may result in patient harm. We reserve the right to terminate service to any user who provides false information.
8. Telehealth Consent
By using this service, you consent to asynchronous store-and-forward telehealth services as permitted under California Business and Professions Code §2290.5. You understand that:
- No real-time physician interaction occurs during intake
- The physician will not physically examine you
- Your prescription history will be verified through the Surescripts national pharmacy network
- Telehealth services carry the same standard of care as in-person visits
- You have the right to request in-person care at any time
9. Not an Emergency Service
This service is not designed for and should not be used in medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.
If you are having thoughts of harming yourself or others, call or text 988 (Suicide and Crisis Lifeline) immediately. Do not use this service for psychiatric emergencies.
10. Limitation of Liability
To the maximum extent permitted by California law, Dr. Refills Medical Group’s liability is limited to the amount you paid for the service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
This limitation does not apply to liability arising from physician negligence or intentional misconduct.
11. Governing Law
These terms are governed by the laws of the State of California. Any disputes shall be resolved in Orange County, California.
12. Changes to These Terms
We may update these terms at any time. Continued use of the service after changes constitutes acceptance of the updated terms. The current version is always posted at drrefills.com/terms.
